Nexkey Limited Warranty

Thank you for purchasing this Nexkey hardware product (the “Product”).  We believe you will be extremely satisfied with its quality, workmanship and performance.  Customer satisfaction is our ultimate goal.  

What the Limited Warranty covers:

Nexkey is the warranty provider for your Product.  Nexkey warrants the Product to be free from defects in material and workmanship during the warranty period.  No on-site service is provided. If a Product proves to be defective in material or workmanship during the warranty period, Nexkey will, at its sole option and as its entirely liability, repair or replace the Product with a new or refurbished product of like kind, within a reasonable period of time after receipt of the defective Product or will issue a refund. Any replacement product or parts may include remanufactured or refurbished parts or components, and the Product will carry the balance of the original product warranty.

How Long the Limited Warranty is Effective:

Products are warranted for one year for all parts and labor from the date of purchase as provided by the original proof of purchase (the “Warranty Period”).  This warranty is valid only during the Warranty Period and only for the first purchase in the USA.  After warranty expiration, the cost to repair or service your Product will be at your expense.  

What the Limited Warranty does not Cover:

  1. Any Product for which the serial number has been modified, defaced or removed.

  2. Any Product that is out-of-warranty as determined by the date on the original proof of purchase.

  3. Removal, installation, re-installation and set-up costs or charges.

  4. Damage, deterioration or malfunction resulting from:

    1. Accident, misuse, neglect, fire, water, lightning, or other acts of nature, unauthorized Product modification, improper installation, or failure to follow instructions supplied with the Product or other events, causes or reasons beyond Nexkey’s control.

    2. Tampering or opening the Product, or attempted repair by anyone not authorized by Nexkey.

    3. Damage due to shipment.

    4. Causes external to the Product, such as electrical power fluctuations or power failure.

    5. Use of supplies or parts not meeting Nexkey’s specifications.

    6. Normal wear and tear, or customer or other third party induced damage to the Product, including criminal acts of third parties and damage caused from use other than normal and proper operation of the Product, as specified in the owner’s manual.

    7. Any other cause that does not relate to the Product or workmanship defect such as non-electrical or mechanical attachments.

Nexkey has not authorized any other party to extend any other warranties in connection with the sale of the Product, and it will not accept any responsibility for any statements, representations, or warranties made by any other person.

How to Obtain Service:

  • Nexkey product is sold though experienced local Channel Partners.

    • If you are a user of Nexkey products at your business please contact your installer for a warranty claim.

    • If you are a Nexkey Channel Partner, please contact support@nexkey.com

  • To obtain service under this Limited Warranty, you will be required to provide (a) the original proof of purchase, (b) your name, (c) your shipping address, phone and email address, (d) a description of the problem, and (e) the serial number of the Product.  You may not ship defective Products to Nexkey without supplying this information to Nexkey.

  • You must ship the defective Product in adequately protective packaging to an authorized Nexkey service location. Following receipt and verification of eligibility, Nexkey, at its option and election, will (i) repair or replace the defective Product within a reasonable time after receipt of the defective unit or provide a refund, and (ii) ship the repaired or replacement Product back to you at Nexkey’s expense, covering all ground shipping costs.  Should you not have the original container/foam, you may request an advanced replacement product with a credit card guarantee for the return of the defective Product. In this case, you should use the container/foam for the advanced replacement product to package and return the defective Product.

Exclusion of damages:

NEXKEY'S LIABILITY IS LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE PRODUCT OR AS OTHERWISE SPECIFIED HEREIN. NEXKEY SHALL NOT BE LIABLE FOR:

  1. DAMAGE TO OTHER PROPERTY CAUSED BY ANY DEFECTS IN THE PRODUCT, DAMAGES BASED UPON INCONVENIENCE, LOSS OF USE OF THE PRODUCT, LOSS OF TIME, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, LOSS OF GOODWILL, INTERFERENCE WITH BUSINESS RELATIONSHIPS, OR OTHER COMMERCIAL LOSS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  2. ANY OTHER DAMAGES, WHETHER INCIDENTAL, CONSEQUENTIAL, SPECIAL, INDIRECT OR OTHERWISE AND WHETHER KNOWN OR SHOULD HAVE BEEN KNOWN BY NEXKEY, INCLUDING LOSS OF PROPERTY AND PERSONAL INJURY RESULTING FROM ANY BREACH OF WARRANTY, THE INABILITY TO USE THE PRODUCT OR UNDER ANY LEGAL THEORY IN CONTRACT OR TORT.  NEXKEY’S LIABILITY IS LIMITED TO THE ACTUAL PURCHASE PRICE PAID BY YOU TO THE RETAIL SELLER OF THE DEFECTIVE PRODUCT.

  3. ANY CLAIM AGAINST THE CUSTOMER BY ANY OTHER PARTY.  

  4. THIS LIMITED WARRANTY AND REMEDIES ARE THE SOLE AND EXCLUSIVE WARRANTIES AND REMEDIES IN CONJUNCTION WITH THE SALE AND USE OF THE PRODUCT.  NO OTHER WARRANTIES, ORAL OR WRITTEN, EXPRESSED OR IMPLIED, ARE GIVEN AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL OTHER WARRANTIES WHETHER STATUTORY, EXPRESS OR IMPLIED, ARE HEREBY DISCLAIMED AND EXCLUDED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

  5. NO NEXKEY DEALER, AGENT OR EMPLOYEE IS AUTHORIZED TO MAKE ANY MODIFICATION, EXTENSION, CHANGE OR AMENDMENT TO THIS LIMITED WARRANTY WITHOUT THE WRITTEN CONSENT AND AUTHORIZATION OF NEXKEY.

Effect of State Law:

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.  Some states do not allow limitations on implied warranties, how long an implied warranty lasts and/or do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and/or exclusions may not apply to you.  IF THE EXCLUSION OR LIMITATION OF AN IMPLIED WARRANTY IS NOT ALLOWED UNDER APPLICABLE LAW, THEN, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DURATION OF SUCH IMPLIED WARRANTY WILL BE LIMITED TO THE SHORTER OF THE SHORTEST DURATION ALLOWED BY APPLICABLE LAW, OR THE WARRANTY PERIOD SET FORTH ABOVE.
